You know in your heart that was an overt threat to lynch Marko.

I don’t know Rap. It was way over the line, and I condemn it roundly. I think is was a ban-worthy offense.

But in order for there to be any real threat, there has to be some kind of belief on the part of the threatened that the threat could be carried out, or would if it could. The threatening words were so over the top, and so out of the realm of reality, that it seems more like childish emotional blustering than an actual threat meant to be taken seriously. I don’t think there’s any way Marko could have felt legitimately intimidated, let alone threatened by JenTheNincompoop’s words.

yes i know in my heart that Jen was very upset with marko to the point of hate and probably did intend to post a threat, but a semi competent defense attorney could easily get it benched as there was no description actually made on exactly what the rope was to be used for. this has to be determined as evidence to be accepted by the court. Jen would surely walk out of this one

Well, I did stay at a Holiday Inn last night.

I think it would be difficult for a prosecutor to establish mens rea in JTNCs hyperbole.

Secondly, you can always get lawyers who are willing to argue legalities, and a smart and determined prosecutor can probably get anything he wants to trial, but if Rap takes a position, you can be near certain of rightness by embracing the opposite.

No. As I said, I used to be an admin of a forum larger than this and I did have legal counsel, and I did receive a crash course on the legalities of conduct by both administrators and users of Internet forums - liability, criminality, all that fun stuff.

This helped me muchly when I would receive phone calls on my home phone from irate users who threatened to sue me unless I removed a ‘defamatory’ post by another user. One was particularly fun - he launched a (very poor) DoS attack against my site - from his workplace, and then thought he could intimidate me. I -begged- him to sue me. Too bad he didn’t follow through.
